You can register an NGO under one of three legal structures:

  • Trust (under the Indian Trusts Act, 1882)
  • Society (under the Societies Registration Act, 1860)
  • Section 8 Company (under the Companies Act, 2013)

The common documents include:

  • PAN card of all members
  • Address proof of members
  • Registered office proof (electricity bill or NOC from owner)
  • Memorandum of Association (MOA) and Articles of Association (AOA)

FCRA (Foreign Contribution Regulation Act) registration allows NGOs to legally receive foreign donations or grants. Without FCRA approval, international funding is not permitted.

While it’s possible to form a Trust with two trustees, Societies and Section 8 Companies generally require at least 7 and 2 members, respectively.
