Eligibility for Society Registration

  1. Minimum Number of Members:
    A society must have at least 7 members in most states. These members act as the founding members or subscribers and are responsible for the initial registration process. The personal details of all members, including full name, residential address, contact information, and identification documents (such as Aadhaar, PAN, or Passport), must be provided during registration. This ensures accountability and legal recognition of the organization.

  2. Memorandum of Association (MOA) and Rules & Regulations:
    Every society must prepare a Memorandum of Association (MOA) and Rules & Regulations, which define the objectives, governing structure, and internal functioning of the organization. The MOA outlines the society’s name, objectives, and address, while the Rules & Regulations describe membership criteria, office bearers, decision-making process, meetings, and operational procedures. Properly drafted MOA and Rules ensure transparency and compliance with legal requirements.

  3. Residency of Members:
    Members of the society must primarily be Indian residents to comply with state-specific regulations. In some states, Non-Resident Indians (NRIs) may also be allowed to become members, subject to additional documentation or permissions.   4. Purpose of the Society:
    The organization’s purpose must be charitable, literary, cultural, educational, scientific, or related to social welfare activities. Only societies with genuine non-profit objectives are eligible for registration. The objectives should promote public interest or social good, rather than private gain. Examples include educational trusts, cultural clubs, charitable organizations, NGOs, social service groups, and scientific societies.

Procedure for Society Registration

1. Name Reservation:
Choose a unique name for your society and get it approved by the Registrar.

2. Drafting MOA & Rules:
Prepare the Memorandum of Association (MOA) and Rules & Regulations, detailing the objectives, structure, and working of the society.

3. Submission of Documents:
Submit the MOA, Rules & Regulations, list of members, and other required documents to the Registrar of Societies in the respective state.

4. Payment of Fees:
Pay the registration fees (varies by state).

5. Certificate of Registration:
Upon approval, the Registrar issues a Certificate of Registration, confirming the legal status of the society.
